Ruling May Trigger Crackdown on E-Cigarettes // Court of Appeals Sided With FDA About “Illegal” Product


2010-04-02 15:00:45 – Wednesday’s ruling by the U.S. Court of Appeals that the Food and Drug Administration [FDA] may continue to block imports of e-cigarettes may embolden the FDA to begin a wider crackdown on sellers of this novel product, suggests public interest law professor John Banzhaf who participated in the legal proceedings.

The court went out of its way in its brief ruling to suggest that the FDA was correct in declaring the product "illegal," noting that "appellants [FDA] have satisfied the stringent standards required for a stay pending appeal."
